At Amplife®, privacy is a fundamental human right. It is also one of our core values. We are committed to protecting your privacy, and we support a policy of openness about how we collect, use and disclose your Personal Information.
"We," "us," or "our" refers to AMPLIFE LLC ("Amplife®"). "You" or "your" refers to the person whose Story is shared through the Amplife® Stories program (the "Program") and, where a minor participates, the parent or legal guardian acting on the minor's behalf.
Amplife® Stories hosts a free page on amplife.co that we build from your submission to feature your Amplife® Story (your "Amplife® Stories Page").
This Privacy Policy covers the Personal Information we handle in connection with the Program, including our submission form, Amplife® Stories Pages and Program features on amplife.co (together, for purposes of this Policy, the "Website"), and Program communications and the related services we provide (the "Services"). Shopping on and browsing amplife.co generally are covered by the Amplife® Privacy Policy, and health-related information is additionally covered by the Amplife® Consumer Health Data Privacy Notice, which applies alongside this Policy. Where those documents and this Policy overlap, the document specific to the activity applies.
By submitting a Story or using our Services or Website, you consent to the collection, use and disclosure of your Personal Information (as defined below) in accordance with the following terms and conditions. Where the law requires a separate consent, for example, for disability or health-related information, or for the public display of your Amplife® Stories Page, we ask for that consent separately, at the point of collection, and your general use of the Website is not treated as that consent.
This Privacy Policy also explains how you can contact us if you have a question about, want to make a change to, or want to delete any Personal Information we may be holding about you. We strongly recommend that you take the time to read this Privacy Policy and retain it for future reference.
Third-party websites and services may have additional privacy policies or statements which govern their practices in collecting, storing, using and disclosing your Personal Information. Please read those additional privacy policies or statements carefully.
What is Personal Information
For the purpose of this Privacy Policy, "Personal Information" means any data that relates to an identified or identifiable individual or that is linked or linkable to them by Amplife®, no matter where the individual lives. This means that data that directly identifies you, such as your name, is Personal Information, and also data that does not directly identify you but that can reasonably be used to identify you, such as your device identifiers, is Personal Information. Aggregated data is considered non-personal data for the purposes of this Privacy Policy.
"Sensitive Personal Information" means Personal Information that reveals information about a disability or health condition, or other categories defined as sensitive under applicable law, including the California Privacy Rights Act (CPRA). Some disability and health information is also "consumer health data" under state health-privacy laws such as Washington's My Health My Data Act.
What Personal Information We Collect
We strive to collect only the personal data that we need. The Personal Information we may collect in the course of you participating in the Program or accessing or using the Website or the Services may include, but is not limited to, the following:

Contact information (such as first and last name, email address, telephone number, city or region, and social media handles, if you choose to share them);

Submission information you provide through our submission form, which is collected for us by our forms service provider and stored in our customer relationship management (CRM) system. This includes the information the form requests, such as your name, contact details, and location, and, only if you choose to share it, information about your disability or health condition, and your Death Cheater® Day (the date you joined the disabled community). Consent to our collection and use of disability or health information is requested through its own separate, unticked checkbox, apart from any other terms;

Your Amplife® Story and other content and likeness information: the first-person Story you write (which often includes deep personal and medical history) and the images, videos, audio, and other media you provide to us for the Program;

Consent records: we collect and retain each participant's signed consent or recorded decline (including verified parent or guardian consent for minors) together with the associated Story and media. We use these records only to honor each person's consent choice;

Communications between you and Amplife® about your submission, your Amplife® Stories Page, and the Program; and
-
Anything else you choose to share with us in your submission or your Story.
Information you give us: We receive and store any information you enter on our Website or give us in any other way. You are not required to provide Personal Information. You provide most of this information when you complete our submission form and in your communications with us.
Meeting and call recordings: With your consent, we may record and transcribe video or phone meetings and calls with you to create notes and summaries. We tell you before recording, and you may decline.
Automatic information: We receive and store certain types of information whenever you interact with us. For example, like many websites, we use "cookies" and we obtain certain types of information when your web browser accesses our Website and other content served by or on behalf of the Website. We may also receive or store information about your mobile device, including a unique identifier for your device, and the general area (such as city or region) inferred from your IP address. We do not collect precise geolocation. Examples of the information we collect and analyze include:

the Internet protocol (IP) address used to connect your computer to the Internet;

computer and connection information such as browser type, version, operating system, and platform;

the full Uniform Resource Locators (URL) clickstream to, through and from our Website (including date and time);

During some visits we may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, and page interaction information.
Email communications: To help us make emails more useful, we often receive confirmation when you open email from us if your computer supports such capabilities. If you do not want to receive email from us, please adjust your communication preferences or contact us.
Information from other sources: The categories of sources from which we collect Personal Information are: you directly; your parent or legal guardian, where a minor participates; and our service providers (such as the forms service provider that operates our submission form).
Your Amplife® Stories Page Is Public
This is the most important section of this Policy, so we want to be direct about it.
The purpose of Amplife® Stories is to share your Story publicly. With your express consent, your Amplife® Stories Page publicly displays: your name; your disability; your Death Cheater® Day; your first-person Amplife® Story, including any personal and medical history you chose to put in it; and the images, videos, audio, and other media you provided. Your Amplife® Stories Page is displayed publicly, including on the internet where anyone can access it. Search engines may index it and show it in search results. Other people may share, quote, or copy it, and copies that other people make are outside our control and may persist even after your page is removed.
Please share only what you are comfortable making public. Your Story is yours: you decide what goes in it, and before your Amplife® Stories Page goes live, we prepare it for your review and publish it only after you approve it.
You can change your decision at any time. If you withdraw your consent, we will unpublish your Amplife® Stories Page and stop new uses of your Story and likeness within a reasonable period, as described in "How Deletion and Consent Withdrawal Work" below. Withdrawal operates on a going-forward basis: it does not undo uses that occurred while your consent was in effect, and it cannot reach copies that other people made or shared while your page was public.
Sensitive Personal Information
Because the Program exists to tell stories from the disabled community, the information you share about your disability or health condition, in our submission form, in your Amplife® Story, and in your images, videos, audio, and other media, is Sensitive Personal Information, and some of it is consumer health data under state health-privacy laws such as Washington's My Health My Data Act. We collect it only with your consent, requested through its own separate, unticked checkbox, apart from any other terms. We use it to review your submission, to build and display your Amplife® Stories Page, and, where you have consented, to feature your Story in Program marketing as described in the Amplife® Stories Participation Agreement. Declining, or later withdrawing, never affects the price or availability of Amplife®'s products or services to you. We never use disability or health information for advertising targeting or profiling, and we do not sell it or share it. Access within Amplife® is restricted to personnel who need it to review submissions and administer the Program.
We do not collect biometric information, and we do not process images, video, or audio to extract biometric identifiers (such as face geometry or voiceprints). We do not collect precise geolocation.
If you are a California resident, you have the right to request that we limit the use and disclosure of your Sensitive Personal Information to the purposes described in this section. You can also change your decision at any time: see "How Deletion and Consent Withdrawal Work" below. Our Consumer Health Data Privacy Notice provides additional detail about how we handle consumer health data and the rights that attach to it. If you are a Washington or Nevada resident, please refer to that Notice for your consumer health data rights and how to exercise them.
How We Use Your Personal Information
We use your Personal Information to:

Review your submission and build and host your Amplife® Stories Page, which we prepare for your review and publish only after you approve it;

Feature your Story and any Co-Created Content in Program marketing, with your consent, as described in the Amplife® Stories Participation Agreement;

Communicate with you about your submission, your Amplife® Stories Page, the Program, and updates to this Policy;

Honor your consent choices, including consents, declines, and opt-outs we have recorded;

Manage, protect and improve the Website and the Services; and

Comply with applicable law and legal process.
We do not use your Personal Information for third-party advertising, and the Website does not use third-party advertising or ad-platform pixels.
We access, store and use Personal Information to provide the Services and as otherwise described in this Policy. We do not review, share, distribute, sell or reference any Personal Information except as described in this Policy or as may be required by law.
We do not sell your Personal Information, including as "sale" is defined under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA) or Nevada privacy law, and we do not "share" your Personal Information for cross-context behavioral advertising as that term is defined under California law.
How We Share Your Personal Information
You expressly consent to the sharing of your Personal Information as described in this policy.
We do not sell, license, trade or rent any Personal Information collected from our Services to or with third parties for their own marketing purposes.
We may share your Personal Information with service providers ("Partner Companies"): companies that perform services for us, such as the forms service provider that operates our submission form, our customer relationship management (CRM) system, the e-commerce and hosting platform that operates amplife.co and hosts Amplife® Stories Pages, our email delivery provider, and our analytics providers. Partner Companies act under written contracts, have access to your Personal Information only to perform these services on our behalf, are obligated not to disclose it to any other party or use it for any other purpose, and are required to protect Personal Information and to comply with the general privacy principles described in this Privacy Policy. Where we share information in aggregated or anonymized form, it does not identify you.
Regardless of any choices you make regarding your Personal Information, we may disclose Personal Information if we believe in good faith that such disclosure is necessary to:

comply with relevant laws or to respond to subpoenas or warrants served on us;

protect or defend our rights or property or those of users of our Services; or

protect the safety of the public or any person, or to prevent or stop any activity we may consider to be, or to pose a risk of being, illegal, unethical or legally actionable.
Although we currently do not have a parent company, any subsidiaries, joint ventures, or other companies under common control, we may in the future. We may share some or all of your Personal Information with these related entities, in which case we will require them to honor this Privacy Policy. If another company acquires our company or our assets, that company will possess the Personal Information collected by it and us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.
We also reserve the right to disclose and/or transfer Personal Information to a third party in the event of a proposed or actual purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, transfer, conveyance or financing of all or any portion of Amplife® or of any of the business or assets or shares of Amplife® or a division thereof.
Your Privacy Rights

No matter where you live, you have the right to request access to or correction of the Personal Information we hold about you by contacting us.You may also withdraw your consent to our use of your Personal Information at any time, on a going-forward basis, as described in "How Deletion and Consent Withdrawal Work" below.

If you are a California resident, you have the following rights:

Right to Know: You may request disclosure of the categories and specific pieces of Personal Information we have collected about you, the categories of sources from which it was collected, the business purpose for collecting it, and the categories of third parties with whom we share it.

Right to Delete: You may request that we delete Personal Information we have collected about you, subject to certain exceptions permitted by law. How deletion interacts with your published Amplife® Stories Page is described below.

Right to Correct: You may request that we correct inaccurate Personal Information we maintain about you.

Right to Opt-Out of Sale or Sharing: We do not sell your Personal Information and do not share it for cross-context behavioral advertising. If this practice ever changes, we will update this Policy and provide the required opt-out mechanism before doing so.

Right to Limit Use of Sensitive Personal Information: You may request that we limit our use of your Sensitive Personal Information to the purposes disclosed in this Policy.

Right to Non-Discrimination: We will not discriminate against you for exercising any of these rights.

How Deletion and Consent Withdrawal Work
Deletion requests and consent withdrawals operate on a going-forward basis:

We will unpublish your Amplife® Stories Page and stop new uses of your Story and likeness within a reasonable period after your request.

Content already published or distributed before your request (for example, a feature of your Story shared on our Amplife® Owned Channels while your consent was in effect) reflects uses that already occurred; withdrawal does not undo uses that occurred while your consent was in effect.

Records we are legally required to keep (such as consent and decline records) are held in a restricted internal archive; public display ends.

For minors, a parent or legal guardian may exercise deletion and consent withdrawal on the child's behalf at any time.

Knowledge and Consent
We collect Personal Information about you, from you, or from third parties you authorize us to collect such information from, only when you voluntarily provide it or authorize us to collect it. Typically, we will seek consent for the use or disclosure of your Personal Information at the time of collection. Where we ask for consent to collect disability or health information, we ask for it separately from any other terms. Amplife® Stories is a voluntary program whose purpose is to share your Story publicly, so consenting to that public display is required to have an Amplife® Stories Page. Declining, or later withdrawing, never changes the price or availability of Amplife®'s products or services to you; it means only that we do not publish, or no longer continue to publish, your Amplife® Stories Page.
You may withdraw consent at any time, on a going-forward basis, as described in "How Deletion and Consent Withdrawal Work." To withdraw your consent, contact us.
We will not, as a condition of the supply of a product or Service, require you to consent to the collection, use or disclosure of information beyond that required to fulfill the explicitly specified and legitimate purposes for which the information is being provided.
Use or Disclosure for Marketing Purposes
If you have not opted out of receiving marketing materials, we may use (but will not disclose) your contact information to tell you about additional goods, services and special offers from us, including by means of direct marketing. We never use your disability or health information for advertising targeting or profiling, and we never sell or share it.
Where you have consented to have your Story featured in Program marketing, that featuring is governed by the Amplife® Stories Participation Agreement and the consent you gave when you shared your Story, recorded in your Amplife® Stories Consent and Likeness Release (or, for minors, the release signed by a parent or legal guardian), and you can withdraw it going forward at any time.
You can choose not to allow us to use your Personal Information for direct marketing purposes by contacting us.
Cookie Policy
When you visit our Website, we place an alphanumeric identifier text file called a "cookie" in the browser directory of your computer's hard drive to enable our systems to recognize your browser and to provide features and storage of your preferences. A cookie is a small piece of information that a website can store on your web browser and later retrieve.

How We Protect Your Personal Information
We make commercially reasonable efforts to ensure that Personal Information collected in the course of you participating in the Program or accessing or using the Website or Services is protected against loss, theft and unauthorized access. This protection applies in relation to information stored in both electronic and hard copy form.
We work to protect the security of your information during transmission by using Secure Sockets Layer (SSL) software, which encrypts information you input. We maintain physical, electronic and procedural safeguards in connection with the collection, storage and disclosure of Personal Information (including Sensitive Personal Information). Our security procedures mean that we may occasionally request proof of identity before we disclose personal information to you.
Disability and health information you share for your Amplife® Stories Page, and the consent records associated with it, are restricted to personnel who need them to review submissions and administer the Program.
Data Breach Notification
In the event of a data breach affecting your Personal Information, we will notify affected individuals without unreasonable delay and within any timeframe required by applicable law. Our notice will describe the nature of the incident and the categories of information involved, and will provide steps you can take to protect yourself. Notification will be provided to the email address you gave us with your submission; where email is unavailable, we will use an alternate contact method permitted by law. Where required, we will notify relevant regulatory authorities within the timeframes specified by law. We require our service providers to notify us promptly of any breach affecting your Personal Information.
Children and Personal Information
Because the disabled community includes people of every age, minors may participate in the Amplife® Stories Program, but only with the verified consent and participation of a parent or legal guardian; a minor does not share a Story on their own. For any child under 13, we obtain verifiable parental consent before collecting the child's Personal Information and handle that information in accordance with the Children's Online Privacy Protection Act (COPPA). Outside the Program, our Website and Services are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13 without verifiable parental consent. If we learn that a child's Personal Information was collected without appropriate parental authorization, we will delete it as soon as possible.
We do not sell or share the Personal Information of any consumer, and we would never sell or share the Personal Information of a consumer under 16 without the affirmative opt-in consent the CPRA requires (the consumer's own consent for ages 13 to 15, or a parent or guardian's consent under age 13).
When a minor participates, the parent or legal guardian gives the verified consent, approves the Amplife® Stories Page before it is published, and may at any time review the child's Personal Information, withdraw consent, and have the child's Amplife® Stories Page removed, as described in "How Deletion and Consent Withdrawal Work."
If you are a parent or guardian and believe your child has provided us with Personal Information, please contact us at hello@amplife.co to request deletion.
Links to Third-Party Sites
The Website may offer links to other third-party websites. We are not responsible for how such third parties collect, use or disclose your Personal Information. It is important to familiarize yourself with their privacy policies before providing them with your Personal Information.
Retention of Your Personal Information
We retain your Personal Information for as long as necessary to fulfill the purpose(s) for which it was collected and to comply with applicable laws. The following general retention periods apply:

Your Amplife® Story, Amplife® Stories Page content, and likeness media: Retained while published with your consent. If you withdraw consent or request deletion, we unpublish and stop new uses as described in "How Deletion and Consent Withdrawal Work," and any copies we are legally required to keep are held in a restricted internal archive.

Consent and decline records: Retained for as long as the associated Story and media are retained, plus any period required by law, so we can demonstrate that each person's consent choice was honored.

Submission information and Program communications: Retained while your Amplife® Stories Page is published and for a reasonable wind-down period afterward, except for records we must keep longer to satisfy legal obligations.

Communication preferences: Retained until you withdraw consent or request deletion, subject to legal exceptions (we keep opt-out records so we can continue to honor them).
Where applicable law requires deletion within a specific period, we complete verified deletion requests within 30 days. We also periodically review the Personal Information we hold and delete or anonymize information we no longer need for the purposes described in this Policy.
Your consent to the purposes described in this Privacy Policy remains valid after your Amplife® Stories Page is unpublished for the periods stated above, subject to your withdrawal rights.
International Transfers of Personal Information
Amplife® is based in the United States. We use third-party service providers that may process and store your Personal Information on servers located in the United States and other countries. If you are accessing the Website from outside the United States, please be aware that your Personal Information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your country of residence.
For individuals in the EEA or UK, transfers of Personal Information to countries not deemed adequate by the European Commission are protected by appropriate safeguards, including data processing agreements with our service providers that incorporate the Standard Contractual Clauses or other transfer mechanisms approved under applicable data protection law. Changes to This Privacy Policy
We reserve the right to modify this Privacy Policy from time to time to reflect changes in legal or regulatory obligations or changes in the manner in which we deal with Personal Information. We will provide at least 30 days advance notice of any material change by email to the address you gave us with your submission and by posting notice on our Website. Where a change is required by law or regulation, it may take effect as soon as reasonably practicable. Non-material changes may be made without advance notice. The Privacy Policy posted on this Website at any given time shall be deemed to be the Privacy Policy then in effect. Prior versions are available in our version history.
Correcting or Updating Your Information
You can help us maintain the accuracy of your Personal Information by notifying us of any changes. You may contact us to request access to, correction of, or an update to your Personal Information.
Because your Amplife® Stories Page is published content, you can also ask us at any time to update it, for example, to correct your Story text or to replace an image or video, and we will apply the changes you approve within a reasonable period.

Amplife® takes your privacy questions seriously. Our team reviews your inquiry to determine how best to respond. We aim to respond to all substantive contacts within seven days. We may require additional information or let you know that we need more time to respond. Requests to exercise privacy rights are answered within the timeframes required by applicable law.
Where your complaint indicates an improvement could be made in our handling of privacy issues, we will take steps to make such an update at the next reasonable opportunity. If you raise a privacy issue with us, we will review the issue and take reasonable corrective steps.
You may at any time, including if you are not satisfied with our response, refer your complaint to the applicable regulatory authority.
